Terms of Service

Welcome to Pinstark ("Pinstark," "we," "our," or "us"). By accessing or using Pinstark at pinstark.com (the "Service"), you ("you" or "User") agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

Pinstark is an AI-powered tool that generates Pinterest pin packs—including titles, descriptions, board suggestions, hashtags, and images—from product URLs provided by users. The Service is designed primarily for affiliate marketers and content creators.

2. Eligibility

You must be at least 18 years old to use the Service. By using Pinstark, you represent and warrant that you meet this requirement and that you have the legal authority to enter into these Terms.

3. Accounts

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Credits

Pinstark offers Free, Starter, Pro, and Studio tier subscriptions. Each pin pack generation consumes one credit. Credits roll over month to month up to a balance of 500. Top-up credit packs are available to active subscribers. Subscriptions auto-renew at the end of each billing period unless canceled. You may cancel at any time, effective at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, obscene, hateful, or violates the rights of any third party
• Generate content that misrepresents products, services, or affiliations
• Attempt to reverse engineer, scrape, or extract data from the Service
• Use the Service to create content for products that violate applicable laws or platform policies
• Bypass tier limits, credit limits, or other technical restrictions
• Use automated tools or scripts to interact with the Service outside of documented API access

6. Affiliate Marketing and Disclosures

You are solely responsible for complying with all applicable laws and regulations regarding affiliate marketing, including the United States Federal Trade Commission (FTC) Endorsement Guides and equivalent regulations in your jurisdiction. Pinstark automatically appends FTC-compliant disclosure language when affiliate links are provided, but you remain responsible for ensuring your final published content complies with all applicable disclosure requirements.

7. AI-Generated Content

The Service uses third-party AI models (Anthropic Claude and Google Imagen) to generate text and images. You acknowledge that:

• AI-generated content may contain inaccuracies and should be reviewed before publication
• AI-generated images may not exactly match the products they represent
• Pinterest and other platforms may label your published content as AI-generated based on their own detection systems
• We do not guarantee the accuracy, suitability, or fitness of AI-generated content for any specific purpose

8. Intellectual Property

You retain ownership of content you generate through the Service for your own use. Pinstark retains ownership of the Service, including the platform, code, design, branding, and underlying systems. By using the Service, you grant Pinstark a non-exclusive, worldwide, royalty-free license to process, store, and display content you submit for the purpose of providing the Service.

9. Third-Party Services

Pinstark integrates with third-party services including but not limited to Pinterest, Anthropic, Google, Supabase, Dodo Payments, Resend, and Cloudflare. We are not responsible for the practices or policies of these third parties.

10. Service Availability

We provide the Service on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

11. Pricing and Payment

Subscription prices are listed at pinstark.com/pricing in U.S. dollars. Prices are subject to change. Existing subscribers will be notified of price changes at least 30 days in advance. Payments are processed by Dodo Payments. Taxes may apply based on your location.

12. Refunds

Subscription refunds are governed by our Refund Policy at pinstark.com/refund-policy. Credit packs are non-refundable due to the immediate consumable nature of the credits. Generation-failure auto-refunds remain in effect: if a Pinstark generation fails due to a system error, the specific credits used are automatically returned to your account.

13. Termination

We may suspend or terminate your account at any time for material violation of these Terms. Upon termination, you will lose access to your account and any unused credits without refund, subject to our Refund Policy.

14. Limitation of Liability

To the maximum extent permitted by law, Pinstark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of the Service. Pinstark's total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty U.S. dollars (USD $50), whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Pinstark and its operators from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

16. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Visakhapatnam, Andhra Pradesh, India.

17. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or by posting a notice on pinstark.com. Continued use of the Service after changes constitutes acceptance.
